RULES OF THE BY DARIIA DAY WOMEN’S DAY GIVEAWAY

ARTICLE 1 – ORGANIZER

The website www.dariiaday.com is published and operated by the company By Dariia Day, registered in Poland under VAT number PL6120008332, with its headquarters located at Otok 126, 59-700 Bolesławiec (hereinafter referred to as "the Organizer"). The publication director is Daria Rambard.

As part of the promotion of its products, By Dariia Day is organizing a free competition with no purchase obligation, titled "By Dariia Day Women’s Day Giveaway", running from March 7, 2025, to March 13, 2025 on Instagram.

ARTICLE 2 – CONDITIONS OF PARTICIPATION

The Giveaway is open worldwide, excluding any regions where such competitions are prohibited by law or where shipping restrictions apply. Participants must:

Be at least 18 years old, or have parental/legal guardian consent to enter.
Have a public Instagram account to validate their participation.
Follow the instructions listed in Article 4 (Terms of Participation).

Exclusions: Employees of By Dariia Day, its partners, affiliates, and their immediate family members are not eligible to participate. The Organizer reserves the right to verify eligibility by requesting proof of identity, age, or residency.

ARTICLE 3 – PRIZES

Two (2) winners will receive a luxurious silk self-care set, each including:

✦ One (1) By Dariia Day Silk Pillowcase (winner’s choice of color and size)
✦ One (1) Silk Eye Mask in Leopard Print
✦ One (1) Matching Silk Scrunchie

The approximate retail value of each prize may vary depending on the selected pillowcase size. Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. The Organizer will cover standard shipping costs, but any customs duties or import taxes applicable in the winner’s country are the responsibility of the winner.

ARTICLE 4 – TERMS OF PARTICIPATION

To participate in the Giveaway, entrants must complete all of the following steps on Instagram:

Follow @dariiaday and @bydariiaday.
Like the official giveaway post.
Comment on the giveaway post with an empowering quote or motto that inspires them.
Tag 3 inspiring friends who they believe would love this giveaway.

⭐ Bonus Entry: Share the Giveaway post in an Instagram Story and tag @dariiaday for an extra chance to win.

Entry Limit:

Only one comment per person will be counted.
A maximum of two entries per participant is allowed (one comment + one Story share).

Failure to comply with any of the above steps will result in an invalid entry. Private Instagram accounts will not be considered unless they are made public during the entry verification period.

ARTICLE 5 – SELECTION OF WINNERS

The selection process consists of two steps:

Step 1: Pre-Filtering Entries

After the Giveaway closes, the Organizer will review all entries to ensure:
✅ Participants followed both required Instagram accounts.
✅ A valid quote or motto was shared in the comment.
✅ Three unique friends were tagged.

Step 2: Random Selection

Once entries are validated, a random draw will determine two (2) winners from the eligible participants.
The selection will be done using an independent random picker tool to ensure fairness.

If a drawn winner fails verification, another winner will be selected until two valid winners are confirmed. The Organizer’s decision is final and binding.

ARTICLE 6 – WINNER ANNOUNCEMENT & PRIZE CLAIM

The winners will be announced on March 14, 2025, through:
✦ An Instagram Story on @dariiaday tagging the winners.
✦ A comment on the original Giveaway post confirming the winners.
✦ A direct message (DM) on Instagram to notify the winners.

Winner Responsibilities:

Winners must respond within 7 days (by March 21, 2025) and provide:
- Full name, shipping address, and pillowcase color/size choice.
If a winner does not respond within 7 days, or is found ineligible, a replacement winner will be drawn using the same method.

The prizes will be shipped within six (6) weeks following winner confirmation. The Organizer is not responsible for lost, delayed, or damaged shipments once they have been handed over to the shipping provider.

ARTICLE 7 – DATA PRIVACY

By entering this Giveaway, participants agree to the collection and processing of their personal data solely for the purposes of:

Verifying participation eligibility.
Selecting and contacting winners.
Shipping prizes to winners.

Data collected: Instagram username, and for winners, full name & shipping address.
This data will not be shared, sold, or used for marketing purposes unless explicit consent is given. Participants can request data deletion at any time, but if requested before the Giveaway concludes, their entry will be voided.

ARTICLE 8 – DISPUTES & LIABILITY

a. Instagram Disclaimer
This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram. By participating, entrants release Instagram from any liability related to this promotion.

b. Fraudulent or Incomplete Entries
The Organizer reserves the right to disqualify any entry that:
❌ Uses fake or duplicate accounts.
❌ Tags the same person multiple times in a single entry.
❌ Fails to follow the required accounts or provide a valid quote.

c. Cancellation or Modification
The Organizer reserves the right to cancel, suspend, or modify the Giveaway at any time if unforeseen circumstances arise (e.g., technical failures, fraud, or legal restrictions).

d. Limitation of Liability
By entering, participants agree to release the Organizer (By Dariia Day) from any liability related to:

Technical issues preventing participation.
Delays or issues in prize delivery beyond the Organizer’s control.
Any injury, loss, or damages resulting from participation or prize usage.

e. Governing Law
This Giveaway is governed by Polish law. Any disputes will be resolved in courts within this jurisdiction.

f. Fake Accounts & Scam Warning
🚨 Beware of fake accounts! Official announcements and winner notifications will ONLY come from @dariiaday or @bydariiaday. The Organizer will never ask for payment information.

ARTICLE 9 – ACCEPTANCE OF RULES

Participation in the Giveaway implies full acceptance of these Official Rules. Any violation may result in disqualification. The Organizer’s decisions are final in all matters related to the Giveaway.
